FAQ: What is Apostille?

On October 5th 1961, the Hague Convention reduced all of the formalities of legalization of documents to the simple delivery of a certificate in a prescribed form, entitled "APOSTILLE", by the authorities of the state where the document originates. Documents sent to foreign countries, must bear an Apostille. Prior to Apostille certification, a notarization or certified copy of the document is required.

What if the foreign country is not a Hague Convention member?

In this case, a Legalization Certificate is required. This process is more complicated than an Apostille, requires more time, and after the document has been notarized and/or certified copy has been obtained, it then may need to be legalized by the consulate of the country in which it will be used.

When do you need an Apostille / Legalization?

If you hold a document that you are planning to use in any country different from the country that issued the document, you need it to be certified by authorities. An Apostille or Legalization is often needed in business transactions, adoptions, extraditions, power of attorneys, birth certificates, marriage certificates, divorce certificates, judgments, death certificates, and so on. Also, if you receiving an inheritance, getting married overseas, or participating in a lawsuit, many documents require an Apostille. This is not the complete list of documents that need an Apostille.
